Temporary Skill Shortage Visa

The TSS visa facilitates targeted use of overseas workers to address temporary skill shortages while ensuring that Australian workers get priority.

This visa requires sponsorship, so your candidate must be nominated for a skilled position and you must be an approved sponsor. In fact, there are three steps that must be completed for a TSS 482 visa.

Sponsorship

The business must meet requirements such as being an active business, lawful and meets employment regulations in order to fulfill the requirements of the sponsorship application.

Nomination

The nomination application should include details that confirm the authenticity of the role, such as position details, salary, proof of efforts to hire an Australian and confirmation that the business is viable to sponsor overseas.

Visa Application

The nominated employee must fill out an application that details character and health requirements, as well as their suitability for the role.

Projects & Temporary Work Visa

The TSS is only one type of temporary work visa in Australia, there are actually several types and each have different criteria and requirements.

The subclass that is the temporary work visa 400 is often referred to as the short stay specialist visa. This is for people who want to travel to Australia to:

  • Undertake short-term, highly specialised, non-ongoing work.

  • In limited circumstances, participate in an activity or work relating to Australia’s interests.

Temporary Work Visa 400 Eligibility

To consider this program, an applicant must:

  • Be invited, or supported, by the organisation the applicant will be working for.

  • Have specialist skills, knowledge or experience that is needed but cannot be found in Australia

The stay time for this visa can be up to 6 months, but in order for a visa to be granted for longer than 3 months the business must make a strong case as to why the additional time is required. The work for this visa cannot be ongoing and needs to be a fixed-term project or area of work, because this visa is not eligible for extension applications.

Permanent residency can be approved based on a variety of different circumstances.

This includes an existing temporary sponsored employee seeking a permanent visa, an international worker seeking an employer sponsored permanent visa or an entrepreneur looking to begin their own business.

Employer Nomination Scheme

The subclass 186 visa is a permanent residence visa for skilled workers. It allows an individual to work in Australia under one of three streams:​

Temporary Residence Transition stream

After 3 years working with the business, your sponsored employee may be eligible to apply for Permanent Residency. The time while employed with the business does not need to be continuous but it does need to be with the same organisation. Please note age and language requirements do apply.

Direct Entry stream

If your employee receives a positive skills assessment and they have a minimum of 3 years of experience in their occupation, they may not be required to wait 3 years with the business before applying for permanent residency. If the company is willing to nominate the employee with their positive skills assessment, they can apply under the Direct Entry Stream. Please note age and language requirements do apply.

Labour Agreement stream

If your business has a current Labour Agreement in place, your employee may be eligible to apply for permanent residency under the Labour Agreement Stream. Please note age and language requirements do apply.

Skilled Visa Australia

This skilled visa 189 subclass is for points-tested skilled workers or eligible New Zealand citizens who are seeking sponsorship either independently or via a nominated state or territory government. This process requires the individual to submit an expression of interest with the aim of receiving an invitation to apply. As part of the application, the individual must also complete a skills test and receive an acceptable score to be eligible for this visa.

The skilled sponsored visa has two subclasses and three streams as detailed below:

Skilled Visa State Nominated Stream

This visa allows nominated skilled workers seeking state nomination to live and work in Australia as permanent residents:

  • Have an occupation on the relevant skilled list
  • Have a suitable skills assessment for the occupation
  • Be invited to apply for this visa by your nominated state
  • Satisfy the points test

Skilled Visa Australia Points Tested Stream

This skilled visa lets invited workers with skills Australia needs live and work permanently anywhere in Australia.

  • You don’t need a sponsor or nominator
  • You must be invited to apply
  • You must be under 45 to be invited

Skilled Visa New Zealand Stream

This skilled migrant visa allows eligible New Zealand citizens who have demonstrated commitment and contribution to Australia, to live and work in Australia permanently.

Key requirements include:

  • You must hold a New Zealand Special Category (subclass 444) visa
  • You must have lived in Australia for at least the last 5 years
  • You must have started living here on or before 19 February 2016
  • You have earnt at TSMIT for a specified minimum period of time

Global Talent Independent Visa

Global Talent Independent Program is a streamlined visa pathway for highly skilled professionals to work and live permanently in Australia in select industries. To be eligible for this visa, you must:

Key requirements include:

  • Must be earning or ability to earn at least $167,500.
  • Prove they are internationally recognised with evidence of outstanding achievements.
  • Be prominent in their field of expertise.
  • Provide evidence that they would be an asset to Australia in their area of expertise.
  • Have no difficulty obtaining employment in Australia or becoming established in their field.
  • Have a recognised organisation or individual in Australia endorse them as global talent, in the same field as the applicant.
